Who we are

CheckMyVCard is operated by Hello Marketing, based in Vadodara, Gujarat, India. You can reach us through our contact page and choose the topic “Legal, privacy or grievance”.

The service

CheckMyVCard lets you create digital business cards that can be shared by link, QR code or NFC tap, collect leads, see simple analytics and, for resellers, offer the service under their own brand. Features and limits depend on your plan and are described on our pricing and features pages.

Your account

You must give accurate information and keep your password safe. You are responsible for everything that happens under your account, and must tell us promptly if you think it has been compromised.

You must be at least 18 years old, or the age of majority where you live, and able to form a binding contract. If you sign up for an organisation, you confirm you are authorised to bind it.

Your content

You own the content you put on your cards, including text, images, logos, links and translations. You give us a worldwide, non-exclusive licence to host, copy, transmit and display that content only as needed to run and improve the service for you. This includes showing public cards to anyone with the link and, unless you turn indexing off, letting search engines list them.

You promise that you have the rights to everything you upload, that it is accurate, and that it does not infringe anyone's rights or break any law. You are responsible for your content and for the consequences of publishing it.

Acceptable use

You must follow our Acceptable Use Policy. In short: no impersonation, spam, illegal, hateful or misleading content, no collecting personal information without a lawful basis, and no attacks on or abuse of the service. We may remove content or suspend accounts that break these rules, and we may report unlawful activity to the authorities.

Free and paid plans

The free plan has no time limit. Paid plans unlock more cards and features and are charged at the price shown on our pricing page when you subscribe, plus applicable taxes such as GST or VAT.

Paid plans renew automatically for the period you chose (monthly or yearly) until you cancel. You can cancel at any time and keep access until the end of the period you paid for. Refunds are covered in our Refund and Cancellation Policy.

We may change prices for future billing periods. We will tell you in advance, and the change applies from your next renewal. Where a payment partner handles billing, their terms also apply to the payment itself.

Resellers

If you use the service as a reseller, the Reseller Agreement applies in addition to these terms. Customers of a reseller are also bound by these terms.

Our rights

The CheckMyVCard software, design, branding and documentation belong to us or our licensors. These terms give you the right to use the service, not to copy it, resell it outside the reseller programme, reverse engineer it or build a competing product from it. Brand names you add as a reseller remain yours.

If you send us feedback or ideas, we may use them without obligation to you.

Privacy

Our Privacy Policy explains how we handle personal information. For leads and other personal data of the people who interact with your card, you are responsible for having a lawful basis to collect and use it, and our Data Processing Addendum describes how we act on your behalf.

Availability and changes

We work to keep the service running but cannot promise it will always be available, uninterrupted or error-free. We may add, change or retire features, and will give reasonable notice of changes that significantly affect you.

Disclaimers

The service is provided “as is” and “as available”. To the fullest extent the law allows, we do not give any warranty of fitness for a particular purpose, uninterrupted operation, or that the information on cards created by users is accurate. We do not verify the identity or claims of card owners.

Limit of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for loss of profit, business, goodwill or data. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim, or INR 5,000 if you use the free plan.

Nothing in these terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.

Indemnity

You agree to cover the reasonable costs and losses we suffer if a third party brings a claim because of content you published or your breach of these terms or the law.

Suspension and ending

You can delete your account at any time from your settings. We may suspend or end accounts that break these terms, put the service or other people at risk, or are unpaid after reasonable notice. When an account ends, your cards stop working and your data is deleted as described in the Privacy Policy. Sections that by their nature should survive (such as liability, indemnity and governing law) continue after the end of the agreement.

Changes to these terms

We may update these terms. If a change matters, we will update the date above and, where appropriate, tell account holders by email or in the dashboard. Continuing to use the service after the change takes effect means you accept the updated terms.

Governing law and disputes

These terms are governed by the laws of India. Before starting a formal claim, please contact us and give us a chance to resolve the issue informally. The courts at Vadodara, Gujarat, India have exclusive jurisdiction over any dispute arising from these terms or the service, except where the law gives you the right to bring a claim in your own country.

General

These terms, with the policies they refer to, are the whole agreement between you and us about the service. If any part is found unenforceable, the rest stays in force. If we do not enforce a right straight away, we have not given it up. You may not transfer your rights under these terms without our consent; we may transfer ours as part of a business transfer.
